23-year-old law student who accused Chinmayanand of rape denies charges in court


A 23-year-old law student who levelled rape allegations against the former Union Minister Swami Chinmayanand, disowned her statement during a hearing in a special MP-MLA court in Lucknow on Tuesday. This comes as a big relief for Chinmayanand who was arrested last year in September after the law student accused him of sexually exploiting her. Swami was arrested from his ashram by a Special Investigation Team (SIT) and UP police. He was granted bail by the Allahabad High Court  in February this year.

When the LLM student appeared before the court, she categorically denied all the allegations she had made earlier against Swami and turned hostile. The angry prosecution immediately appealed to the court to move an application under Section 340 of the CrPC (false claim in a case) against the student, seeking action against her for perjury.

Last year, a law student enrolled in Shahjahanpur law college run by Swami Chinmayanand’s trust, had accused him of rape and had filed an FIR against him on September 5, nearly a week after her father had alleged that the 23-year-old had gone missing. Following the FIR Swami was arrested 20, 2019 and lodged in jail. The case against Swami was registered under Section 376-C of the IPC that criminalises sexual intercourse by a person in authority.

Soon after Swami’s arrest, the law student was also taken into custody on the charges of extortion. She was charged for allegedly extorting Rs. 5 crore from the former Union Minister. An SIT team was constituted to investigate the case and a chargesheet in the rape and extortion case against the student and three others was filed on November 6 by the team.

In December last year, the Allahabad High Court had granted bail to the 23-year-old woman in the extortion case.

72-year-old Chinmayanand also faced charges under Sections 342 (Punishment for wrongful confinement), Section 354-D (Punishment for stalking of women) and Section 506 (Punishment for criminal intimidation) of the IPC.
