
The Supreme Court refused to entertain a petition on Wednesday seeking to prevent a ‘mahapanchayat’ proposed to be held by Hindutva groups in Purola town of Uttar Kashi district in Uttarakhand, alleging that it would increase communal tensions in the hill state.
The Vacation Bench of Justice Vikram Nath and Justice Ahsanuddin Amanullah refused to entertain the petition, stating that the petitioner should trust the High Court.
Terming it as an administrative issue, the top court of the country asked the petitioner about the urgency to approach the Supreme Court, when the High Court was there.
It asked as to why the petitioner was distrusting the High Court. It further questioned the ‘short circuiting’ of the petitioner, noting that the Apex Court was neither on merits nor on cause on the plea.
The Apex Court said the High Court also had jurisdiction. The petitioner should have some trust on the administration.
Filed by the Association for Protection of Civil Rights, the plea was mentioned before the Apex Court by Advocate Sharukh Alam, seeking urgent listing as the mahapanchayat (conclave) was scheduled to be held on June 15.
Alam apprised the top court of the country that an ultimatum has been given by certain groups to a particular community to leave the place before the conclave.
She pointed out that the Supreme Court had earlier issued a mandamus to the Uttarakhand government to take steps to ensure that no hate speeches were made.
However, the Apex Court refused to entertain the petition.
The petitioner then asked for permission to withdraw the plea, seeking liberty to move the High Court.
The Vacation Bench then dismissed the plea as withdrawn, giving liberty to the petitioner to move the High Court or any other authority for relief.
