The Uttarakhand High Court issued notice on a Public Interest Litigation (PIL) filed alleging unauthorized and unabated construction in the private forest known as Jones Estate, also known as June Estate, in Bhimtal, District Nainital.
The Division Bench of Chief Justice Vipin Sanghi and Justice Rakesh Thapliyal find that the petitioner has neither impleaded the private respondents, who allegedly are carrying on illegal construction, or who have carried out illegal construction. He has not filed any photographs in support of his averments in the petition.
It is directed by the High Court to the petitioner to take steps to implead all persons, who allegedly have carried out illegal construction in the forest area, and also to place on record photographs of the allegedly raised illegal construction.
The Court has listed the matter on 03.08.2023 for further hearing.
