Allahabad High Court directs DM to decide on shifting, selling of workshop within 6 weeks

The Allahabad High Court has directed the District Magistrate to take a decision on the matter of allowing the Industrial Tanner Cooperative Society Limited to sell the workshop after shifting it from the populated area of Mathura.

The Division Bench of Justice Mahesh Chandra Tripathi and Justice Manjive Shukla passed this order while hearing a petition filed by Industrial Tanner Cooperative Society Ltd.

The writ petition has been filed seeking direction in the nature of mandamus directing Respondent Nos 2 and 3 to allow the petitioner to execute the sale-deed of workshop.

It is also prayed to direct the Respondent Nos 2 and 3 to decide the representation dated 30.08.2022 and 29.09.2022.

Counsel for the petitioner submitted that work of the petitioner’s Society is to make the leather from animals skin as well as the disposal of the dead animal which has been running under the Government Policy.

Later the said Society came under the ‘Aabadi’ and due to increase in pollution, the workshop of the Society was banned in the year 2007 and it was directed that the same be shifted outside the ‘Aabadi’ area.

Further it is submitted that Applications dated 30.08.2022 and 29.09.2022 were given by the petitioner to Respondent No 3 requesting that the petitioner may be given the permission to shift the workshop and petitioner may be allowed to execute the sale-deed but no decision on the aforesaid applications has been taken yet.

Considering the facts and circumstances of the case, without advertising to the merits of the case and on consent, the petition is disposed by the Court asking the petitioner to move a fresh representation annexing all relevant materials in support of his case and ventilating his grievance before the District Magistrate, Mathura (respondent no. 3) within two weeks.

“In case, any such application is being preferred, we hope and trust that the authority concerned would proceed to decide the same strictly in accordance with law, as expeditiously as possible and preferably within six weeks thereafter after taking comments from Respondent No 4, District Khadi Gram Udyog Adhikari, Mathura”, the order reads.
